Holdings:

The Virginia Court made the following holding:

  • Under 8 U.S.C.S. §§ 1101(a)(42)(A), 1158(a), to be eligible for asylum, an alien must show persecution or a well-founded fear of persecution in his native country on account of race, religion, nationality, membership in a social group, or political opinion. A well-founded fear of persecution is established if a reasonable person in the circumstances would fear persecution on one of the five enumerated bases.
  • Corroborative, documentary evidence is not necessary for an asylum applicant to sustain her burden of proof where the applicant's testimony is sufficiently consistent, specific, and credible. A reviewing court accords great weight to credibility determinations by an immigration judge and the Board of Immigration Appeals, provided the determination is supported by specific, cogent reasons.
